NOTICE OF PRIVACY PRACTICES (HIPAA)
This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
We are required by law to maintain the privacy and security of your Protected Health Information (“PHI”), give you this Notice, and follow it. We will notify you if a breach compromises the privacy or security of your PHI.
Get an electronic or paper copy of your record and other information we have about you. We will provide a copy or summary, usually within 30 days. A reasonable fee may apply.
Ask us to correct your record if you think it is incorrect or incomplete. We may say “no,” but we’ll tell you why in writing.
Request confidential communications (for example, contact you at a different phone or address).
Ask us to limit what we use or share. We will consider all requests; we must agree when you pay out-of-pocket in full and ask us not to share that item/service with your health plan.
Get a list (“accounting”) of certain disclosures we made in the past six years, excluding those for treatment, payment, and health care operations, and certain other exceptions.
Get a copy of this Notice at any time, even if you agreed to receive it electronically.
Choose someone to act for you (legal guardian or someone with a medical power of attorney). We will verify their authority before we act.
File a complaint if you believe your privacy rights were violated: with us at nfrancis@peer2peer.care or (914) 364-6224, or with the U.S. Department of Health & Human Services, Office for Civil Rights. We will not retaliate.
We typically use or share your PHI in the following ways:
Treatment: To provide, coordinate, or manage your care (e.g., sharing with your physicians or other providers).
Payment: To bill and obtain payment from you, your health plan, or other payers.
Health Care Operations: For quality assessment, training, licensing, audits, and business management.
Business associates who perform services for us under contracts that protect your PHI.
Public health & safety purposes (e.g., reporting abuse/neglect, preventing serious threats to health or safety).
Health oversight activities, audits, and inspections.
Legal and law enforcement requests (e.g., court orders, subpoenas, locating a person).
Coroners, medical examiners, funeral directors; organ/tissue donation organizations.
Research under certain approvals or with your authorization.
Workers’ compensation, disability, or similar programs.
Specialized government functions (e.g., military, national security, protective services) as permitted.
Inmates or correctional institutions to provide health care or for safety in compliance with law.
We will obtain your written permission before:
Using or disclosing PHI for most marketing purposes.
Any sale of your PHI.
Most uses and disclosures of psychotherapy notes (if applicable).
You may revoke an authorization at any time in writing, except to the extent we have already relied on it.
Appointment/Service communications: We may contact you about scheduling, case coordination, or care options.
Fundraising: We may contact you for limited fundraising; you can opt out of further messages.
Breach notification: We will notify you if a breach of your unsecured PHI occurs.
We limit PHI to the minimum necessary for the purpose and use safeguards to reduce incidental disclosures, as HIPAA requires.
If a state privacy law offers greater protection than HIPAA, we will follow the more protective law.
We may change this Notice and the changes will apply to all information we maintain. The Effective Date above shows the latest revision. We will post the current Notice on our website and provide it upon request.
